Terms of Service

These Terms of Service ("Terms") govern your use of the Questing RL mobile application and website at questingrl.com (collectively, the "Service") operated by Questing RL LLC ("Company," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. Users between 13 and 18 require parental consent. By using the Service, you represent that you meet these requirements.

2. Accounts

Some features require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@questingrl.com if you believe your account has been compromised.

You may not create accounts using automated means or create accounts under false pretenses.

3. Subscriptions and Payments

3.1 Free Tier

The Questing RL app is free to download. Players may join and participate in hunts, download Shared Journeys, and record personal journeys at no cost.

3.2 Creator Subscription

Creating hunts, Shared Journeys, and accessing cloud sync features requires a paid Creator subscription at the rates listed on our pricing page. Subscriptions are billed monthly or annually as selected at purchase.

3.3 Billing

Subscriptions purchased through our website (questingrl.com) are processed by Stripe. Subscriptions purchased through the Google Play Store or Apple App Store are subject to the respective store's billing terms. By subscribing, you authorize us to charge your payment method on a recurring basis.

3.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to Creator features until the end of the period you have paid for.

3.5 Refunds

Subscriptions purchased through our website are eligible for a full refund within 7 days of the initial purchase if you have not used the Creator features. After 7 days or after using Creator features, refunds are at our discretion. Subscriptions purchased through app stores are subject to the respective store's refund policy.

3.6 Price Changes

We may change subscription pricing with 30 days notice. Price changes will not affect your current billing period.

4. User Content

4.1 Your Content

You retain ownership of all content you create using the Service, including journeys, hunt stops, clue text, narration recordings, and photos ("User Content").

4.2 License to Us

By creating content in the Service, you grant us a limited, non-exclusive license to store, process, and transmit your User Content solely for the purpose of providing the Service to you. We do not use your content for advertising, training AI models, or any purpose beyond operating the Service.

4.3 Content Standards

You agree not to create or share content that:

Violates any applicable law or regulation
Is defamatory, obscene, or harassing
Infringes any third party's intellectual property rights
Contains malware or harmful code
Facilitates illegal activity
Violates our Acceptable Use Policy

5. GPS and Location Features

You are solely responsible for your safety when using location-based features. The Service does not replace your judgment about safe routes, terrain, weather, or physical conditions. By using GPS features, you acknowledge that:

GPS accuracy varies and may not be reliable in all environments
You should not use the app while driving or operating machinery
You are responsible for being aware of your physical surroundings
Hunt and journey routes you create may be used by others — you are responsible for ensuring routes you create are safe and legally accessible

6. Prohibited Uses

You may not use the Service to:

Stalk, harass, or monitor another person without their consent
Place hunt stops on private property without permission
Create content designed to mislead players into unsafe locations
Attempt to gain unauthorized access to our systems
Reverse engineer or attempt to extract source code from the app
Use the Service in any way that violates applicable laws

7. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by Questing RL LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. GPS accuracy is not guaranteed. We are not responsible for decisions you make based on information provided by the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUESTING RL LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Questing RL LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved by binding arbitration under the American Arbitration Association's Consumer Arbitration Rules, except that either party may seek injunctive relief in court for intellectual property violations.

YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notification at least 14 days before changes take effect. Your continued use of the Service after changes take effect constitutes acceptance.
